Terms of Use

What this covers
These Terms of Use (the "Terms") govern access to and use of the websites mmcganalytics.com and app.mmcganalytics.com, including all maps, data layers, analytics, reports, narratives, exports, documentation, and other content and functionality made available through them (collectively, the "Services"). The Services are owned and operated by MMCG Invest, LLC, a California limited liability company with offices at 27 Maiden Ln, Suite 625, San Francisco, CA 94108 ("MMCG," "we," "us").
By accessing or using the Services, you accept these Terms on your own behalf and, where you act for a company or other organization, on behalf of that organization, and you represent that you have authority to bind it. If you do not accept these Terms, do not use the Services.
Paid subscriptions, where offered, are governed by the subscription or order terms presented at the point of purchase, which incorporate these Terms. If those subscription terms conflict with these Terms, the subscription terms control for the paid services they cover.
1. Eligibility and Intended Use
The Services are professional analytical tools intended for business use by commercial lenders, development companies, investors, consultants, and similar organizations. You must be at least 18 years of age and acting for business purposes to use the Services. The Services are not directed to consumers and are not intended for personal, family, or household use.
2. Accounts
Certain features require an account. You agree to provide accurate registration information, to keep it current, and to protect your credentials, including any multi-factor authentication method associated with your account. You are responsible for activity occurring under your account. Notify us promptly at privacy@mmcginvest.com if you suspect unauthorized access. Accounts are issued to named individuals and may not be shared. We may suspend or terminate accounts that violate these Terms.
3. The Services; Availability and Change
The Services are under active development. We may add, modify, suspend, or discontinue features, data layers, or coverage at any time. Certain features may be designated as limited availability, preview, or internal beta; those features are provided for evaluation, may change or be withdrawn without notice, and should not be relied upon for production decisions. We do not warrant that the Services will be uninterrupted or error free.
4. License
Subject to these Terms, MMCG grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access the Services and to use content lawfully obtained through them for your internal business purposes, including inclusion of excerpts in materials you prepare for a specific transaction, provided attribution to the underlying government source is preserved where displayed. All rights not expressly granted are reserved.
5. Acceptable Use
You will not, and will not permit or assist any third party to:
- resell, redistribute, sublicense, syndicate, or otherwise make the Services or any substantial portion of their data available to any third party, or use them to build, train, enhance, or populate a competing product, database, or machine-learning model;
- access the Services by any automated means, including scraping, crawling, harvesting, or bulk downloading, except through interfaces we expressly provide for that purpose;
- circumvent, probe, or test any access control, rate limit, suppression mechanism, or security measure, or access data or accounts you are not authorized to access;
- remove, alter, or obscure any provenance notice, source attribution, publisher disclaimer, or proprietary notice displayed with any content;
- use the Services to locate, profile, contact, harass, or harm any individual, or to make decisions about any individual;
- use the Services in violation of applicable law, or upload unlawful, infringing, or malicious content.
We may throttle, suspend, or terminate access that we reasonably believe violates this Section.
6. Not a Consumer Reporting Agency; Prohibited FCRA Use
MMCG is not a consumer reporting agency as defined by the Fair Credit Reporting Act, 15 U.S.C. 1681 et seq. ("FCRA"), and the Services do not constitute consumer reports. The Services aggregate public records and analytics concerning real property, businesses, and markets for commercial analysis. You may not use the Services, or any information obtained through them, in whole or in part, as a factor in establishing any individual's eligibility for credit, insurance, employment, housing, licensing, or any other purpose covered by the FCRA, and you may not use them for tenant screening or individual background screening of any kind. If your use case requires a consumer report, you must obtain it from a consumer reporting agency. You certify that you will use the Services only for commercial purposes not covered by the FCRA, and this certification is a condition of your license.
7. Not an Appraisal; Not Investment, Legal, or Tax Advice
Nothing in the Services constitutes an appraisal, an evaluation, or the output of an automated valuation model for purposes of any federally related transaction. Content in the Services was not prepared by a state licensed or certified appraiser and was not prepared in accordance with the Uniform Standards of Professional Appraisal Practice. Nothing in the Services constitutes investment, legal, tax, or accounting advice or a recommendation to extend credit, invest, or enter into any transaction, and MMCG is not a registered investment adviser or broker-dealer. Credit, investment, and underwriting decisions are yours alone, made under your own policies and professional judgment.
8. Independent Verification; No Reliance
The Services compile data from government and third-party sources and present analytics derived from them. Source records contain errors, omissions, and lags, and derived analytics inherit them. You are responsible for independently verifying any information material to a decision before acting on it, using original records and appropriate professional diligence. You agree that you will not treat the Services as a substitute for such verification and that MMCG has no responsibility for decisions made in reliance on the Services.
9. Government Data; Publisher Disclaimers
Substantial portions of the Services are compiled from federal, state, and county government records, including county assessor and cadastral records, filings with the U.S. Securities and Exchange Commission, data released by the U.S. Small Business Administration under the Freedom of Information Act, and geospatial data of the U.S. Census Bureau, the U.S. Geological Survey, and the U.S. Department of Agriculture. No government agency sponsors, endorses, or is affiliated with MMCG or the Services, and no reference to any agency implies endorsement.
Parcel and cadastral data are compiled for informational purposes only, are not a legal survey and are not legally binding or certified documents, and are provided without warranty of any kind by their government publishers. Where a government publisher requires that specific disclaimer or attribution language accompany its data, that language is displayed with the relevant layer in the Services and forms part of these Terms for that layer. Government records remain with, and are controlled by, the issuing office; the Services display a copy as of the stated effective date.
10. AI-Assisted Content
Certain narratives, summaries, and analytical outputs in the Services are generated with the assistance of artificial intelligence and are reviewed under MMCG's editorial controls. Factual assertions in AI-assisted outputs should not be relied upon without independently checking their accuracy; they may be inaccurate, incomplete, misleading, or not reflective of recent events. AI-assisted outputs are identified where they appear.
11. Relationship to MMCG Professional Services
MMCG Invest, LLC separately provides feasibility studies and related consulting services under written engagement agreements. Those professional services are governed exclusively by the applicable engagement agreement and applicable professional standards, not by these Terms, and nothing made available through the Services constitutes a deliverable, opinion, or work product under any such engagement. Use of the Services does not create a consulting, advisory, or fiduciary relationship with MMCG.
12. Customer Content
If you upload content to the Services, including documents submitted to a secured client vault, you retain ownership of it. You grant MMCG a license to host, process, display to your authorized users, and back up that content solely to provide the Services and as directed by the applicable engagement or subscription agreement. You represent that you have the rights necessary to upload the content and that it does not violate law or third-party rights. Handling of personal information within uploaded content is described in the Privacy Policy.
13. Intellectual Property; Feedback
The Services, including their software, design, compilations, derived analytics, scores, and documentation, are the property of MMCG or its licensors and are protected by intellectual property laws. MMCG, MMCG Analytics, and associated logos are trademarks of MMCG Invest, LLC. If you provide feedback or suggestions, you grant MMCG a perpetual, irrevocable, royalty-free license to use them without restriction or obligation.
If you believe content in the Services infringes your copyright, send a written notice containing the information described in 17 U.S.C. 512(c)(3) to the contact in Section 20.
14. Third-Party Services
The Services interoperate with third-party services, including payment processing, hosting, geocoding, and AI processing, and may link to third-party sites. Those services are governed by their own terms, and MMCG is not responsible for them.
15. Disclaimer of Warranties
THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MMCG DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, TIMELINESS, AND UNINTERRUPTED OR ERROR-FREE OPERATION. NO ADVICE OR INFORMATION OBTAINED FROM MMCG OR THROUGH THE SERVICES CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MMCG AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MMCG'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO MMCG FOR THE SERVICES IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM AND (B) ONE HUNDRED U.S. DOLLARS. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED BY LAW. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
17. Indemnification
You will defend, indemnify, and hold harmless MMCG and its members, officers, employees, and agents from and against claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of your content, your use of the Services in violation of these Terms, including any use prohibited by Section 6, or your violation of law or third-party rights.
18. Suspension and Termination
You may stop using the Services at any time. We may suspend or terminate your access, with notice where practicable, for violation of these Terms, for risk to the Services or other users, or where required by law. Sections 6 through 10 and 13 through 21 survive termination.
19. Changes to These Terms
We may update these Terms. For material changes, we will notify registered account holders by email or by in-product notice before the changes take effect, and we will update the date at the top of this page. Continued use of the Services after the effective date of a change constitutes acceptance. For registered account holders, silent posting alone will not effect a material change.
20. Governing Law; Venue; Notices
These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. The exclusive venue for any dispute arising out of or relating to these Terms or the Services is the state or federal courts located in San Francisco County, California, and each party consents to their jurisdiction. Legal notices to MMCG must be sent to MMCG Invest, LLC, 27 Maiden Ln, Suite 625, San Francisco, CA 94108, with an electronic copy to privacy@mmcginvest.com. Notices to you may be sent to the email address associated with your account.
21. General
These Terms, together with the Privacy Policy and any subscription or engagement terms that incorporate them, are the entire agreement between you and MMCG regarding the Services. If any provision is held unenforceable, the remainder continues in effect. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. Failure to enforce a provision is not a waiver. Neither party is liable for delay or failure caused by events beyond its reasonable control. You will comply with applicable export control and sanctions laws in using the Services.

The Privacy Policy describes how personal information is handled, both for visitors and account holders and for individuals who appear in the public-record datasets the Services display. Section 12 above sends handling of personal information in uploaded content there, and Section 21 makes the two documents one agreement.
