Regulatory takings analysis requirement
Idaho Code establishes a review process for evaluating whether a proposed regulatory or administrative action by a state agency or local government may result in a taking of private property. A property owner may request a written taking analysis, and a governmental action is voidable if the analysis is not prepared after a request has been made. The written request must be filed not more than 28 days after the final decision, and the completed analysis must be provided no longer than 42 days after the date of filing.
