What does Florida law require before a site is developed?
Zoning enabling statute
Section 163.3202, Florida Statutes, requires each county and each municipality to adopt land development regulations that are consistent with and implement its comprehensive plan, within 1 year after submitting that plan for state review. A general zoning code is not required if the local government's adopted land development regulations meet that section's requirements.

Comprehensive plan requirement
Section 163.3184, Florida Statutes, requires local governments to process most comprehensive plan amendments through the expedited state review process. Certain plan amendments must instead follow the state coordinated review process, under which the state land planning agency reviews the plan or amendment. Once the agency determines that an adopted plan amendment is complete, it has 45 days to determine whether the amendment is in compliance with the act.

Small scale plan amendments
Section 163.3187, Florida Statutes, allows a small scale comprehensive plan amendment where the proposed amendment involves a use of 50 acres or fewer. It requires only one public hearing before the local governing board, held as an adoption hearing. The amendment does not become effective until 31 days after adoption.

Who may practice engineering
Section 471.003, Florida Statutes, provides that no person other than a duly licensed engineer may practice engineering or use the title of licensed engineer or professional engineer in Florida. A licensed engineer whose principal practice is civil or structural engineering may perform architectural services that are purely incidental to the engineering practice, and a licensed architect may perform engineering services purely incidental to the architectural practice. However, an engineer may not practice architecture or use the designation architect, and an architect may not practice engineering or use the designation engineer.

Impact fees
Section 163.31801, Florida Statutes, requires each local government that adopts an impact fee by ordinance, and each special district that adopts one by resolution, to provide notice at least 90 days before the effective date of a new or increased impact fee. An increase of more than 25 percent but not more than 50 percent of the current rate must be phased in over four equal installments beginning on the date the increased fee is adopted.

Which permits and hazards apply to a site in Florida?
State environmental agency
The Florida Department of Environmental Protection is the state's lead agency for environmental management and stewardship, protecting the state's air, water and land. Its NPDES Stormwater Program, based in Tallahassee, is responsible for the development, administration and compliance of rules and policy to minimize and prevent pollutants in stormwater discharges.

NPDES stormwater discharge permit
Florida's NPDES Stormwater Program regulates point source stormwater discharges from three types of activity: construction activities, industrial activities, and municipal separate storm sewer systems. An operator of one of these activities is required to obtain NPDES coverage before discharging stormwater that has the potential to enter a surface water of the state or a municipal separate storm sewer system.

Water management district construction permit
Section 373.413, Florida Statutes, allows the governing board of a water management district, or the department, to require a permit for the construction or alteration of a stormwater management system, dam, impoundment, reservoir, appurtenant work or works. A person proposing such work that is subject to a permit must apply to the governing board or the department.

Building code
Section 553.73, Florida Statutes, directs the Florida Building Commission to adopt the Florida Building Code by rule, covering the design, construction, alteration and demolition of public and private buildings statewide. Provisions relating to wind resistance or the prevention of water intrusion may not be modified to diminish those construction requirements, though the commission may modify them to enhance those requirements. Local governments may adopt their own more stringent technical amendments to the code, but not more than once every 6 months.
