Adirondack Park Agency jurisdiction
The Adirondack Park Agency was created in 1971 by the New York State Legislature to develop long-range land use plans for both public and private lands within the boundary of the Park. The Park's boundary encompasses approximately 6 million acres, roughly half of which is private land, and projects of regional significance usually require a permit from the Agency.

State wetlands threshold and buffer
New York regulates freshwater wetlands of 12.4 acres or greater under the Freshwater Wetlands Act, and protects a 100-foot adjacent buffer around each jurisdictional wetland.

What does New York law require before a site is developed?
Zoning enabling statutes
Local governments are authorized to divide the community into zoning districts and to regulate the use, construction, and alteration of buildings and land within those districts, under Town Law, Village Law, and General City Law. A zoning measure adopted as a local law needs a public hearing on at least 5 days' notice, but a municipality's own local law may set a general notice period of as little as three days. The measure must also sit before the legislative body for at least 7 days before adoption, longer if mailed to members.

Construction stormwater permit
An owner or operator of a construction activity in New York must operate under an effective individual SPDES permit or obtain coverage under the SPDES General Permit for Stormwater Discharges from Construction Activity, issued by the Department of Environmental Conservation under Article 17 of the Environmental Conservation Law. The general permit's first eligibility item is disturbance of one or more acres of soil.
